Harassment Globally Defined

emTRAiN, Inc., a provider of multi-media online human resources compliance training, introduced a Web-based, hosted Global Harassment Prevention course designed to help multinational companies achieve a more consistent workforce culture and protect themselves against employment claims and litigation.

The program parallels emTRAiN's U.S., Canadian, and various state versions, of harassment prevention courses with a multinational perspective.

It covers emerging definitions and directives of the European Union, the International Labour Organization, and other topics, including:

• An overview of the commonly accepted definition of unlawful harassment.

• Practical examples and workplace scenarios to illustrate the types of conduct that constitute sexual and other types of harassment.

• The complaint and investigation process.

• Strategies to help prevent workplace harassment.

"The world is a much smaller place than it was 20 years ago, and it's relatively common to have employees travel to and interact with employees in another country," says Janine Yancey, CEO and founder of emTRAiN. "When that happens, it's critical to ensure everyone gets the same message as to what is acceptable or unacceptable workplace conduct."

"I’m aware of one particular company where it was a well-known 'joke' that for every U.S.-based employee sent to work abroad, or every non-U.S. worker sent to work in the U.S.," says Yancey, "the company would receive at least two harassment lawsuits. That's simply not the way to foster a productive company culture, nor does it reflect good risk management practices."

A built-in tracking mechanism provides audit-quality proof of training, which can be used as evidence in employment litigation cases. "If a claim is filed, often the first thing investigators will ask for are the training records for everyone involved, including the content that was delivered," says Yancey. "If your records are insufficient, that's one strike against you already. The emTRAiN system stores that data for every employee, so providing the records is as simple as running a report and handing it over."

Separate versions for employees and managers provide guidance specific to individual roles on how to respond to harassment activity, obligations to the organization in the event of harassment, and general parameters on the investigation of claims.

emTRAiN employed a Hollywood production company, along with a cast of actors, to depict real world office scenarios. "Scenes on texting, e-mail forwards, and other social media interaction, demonstrate new areas that were not nearly as problematic just two years ago," says Yancey. "Trainees report they remember these scenarios and use them to gauge possible hot spots in the workplace."
